What do the changes in December 2023 bring for Romanian Exporters?

New system

Starting in December of this year, Romanian exporters are facing significant changes in the methods of registering and completing customs documentation due to the introduction of the Automated Export System (AES). This innovation aims to unify and increase transparency in the export process within the European Union.

Through the AES system, exporters can provide detailed information about exported goods, including descriptions, values, destinations, transportation, and other relevant details. As of December 2023, all European Union member states will be obligated to use the AES system, with exceptions for specific cases such as low-value exports or temporary exports.

Exporters or their authorized representatives are required to register in the AES system and electronically upload customs documents.

Improvements

AES promises to facilitate rapid and accurate information exchange between exporters, customs authorities, and other government agencies, thereby contributing to the efficiency of the export process and compliance with government regulations.

While AES brings automation and efficiency to export declarations by eliminating manual forms and providing real-time monitoring of trade flows, its implementation also poses challenges and costs, requiring proper preparation, staff training, and reliance on a robust IT infrastructure, with potential delays and errors.

Failure to comply with the rules carries financial sanctions and penalties, impacting reputation and business relationships.

AEO

To assist AEO-certified (Authorized Economic Operator) exporters, approximately 260 economic entities, the Romanian customs authority has identified solutions to streamline the customs process, including the approval of locations/warehouses held by these authorized AEO exporters as “authorized places for presenting goods.”

If the customs office decides to conduct export controls, these can take place directly at these locations, with the customs office having 60 minutes to decide whether to inspect the goods. If this time elapses without an inspection, automatic customs clearance is granted. If the computer system selects goods for control, customs clearance can only be obtained after the inspection.
